1. Acceptance of Terms

By accessing or using the Symreach platform and services (the "Service"), available at symreach.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Symreach reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Symreach is a software-as-a-service (SaaS) communication platform designed for licensed insurance professionals. The Service enables insurance agents and agencies to:

  • Communicate with their clients via SMS text messaging
  • Manage client relationships and communication preferences
  • Schedule and send appointment reminders and policy-related notifications
  • Track and manage client consent and opt-out preferences
  • Maintain compliance with telecommunications regulations including TCPA

Symreach facilitates direct communication between insurance agents and the clients they serve. Insurance agents using our platform maintain independent, direct relationships with their clients and are responsible for ensuring proper consent is obtained before initiating communications.

3. SMS Terms and Conditions

Program Information

  • Program Name: Symreach Agent Communication Service
  • Program Description: Symreach enables licensed insurance agents and agencies to communicate with their clients via SMS regarding insurance inquiries, appointment scheduling, policy information, and related customer service communications. Messages are sent on behalf of specific insurance agents you have engaged with.

By providing your phone number and opting in to receive text messages, you consent to receive recurring SMS messages from your insurance agent through the Symreach platform.

  • Message Frequency: Message frequency varies based on the nature of your insurance inquiry and your interaction with your agent. You may receive approximately 2–10 messages per month.
  • Message and Data Rates: Message and data rates may apply. Symreach is not responsible for any charges from your mobile carrier. Please contact your carrier for details about your messaging plan.
  • Opt-Out — STOP: You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation message and no further messages will be sent. You may also contact us at support@symreach.com to request removal from messaging.
  • Help — HELP: Reply HELP to any message for assistance. You may also contact our support team at support@symreach.com for any questions or concerns.
  • Supported Carriers: Compatible with major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, and others. Carriers are not liable for any delayed or undelivered messages.
  • Privacy: Your privacy is important to us. Please review our Privacy Policy for details on how we handle your information. Messaging consent and opt-in data will not be shared with third parties.

4. User Responsibilities — Business Clients

If you are an insurance agent, agency, or business using the Symreach platform, you agree to:

  • Use the Service only for lawful purposes and in compliance with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable state regulations.
  • Obtain and document proper consent from clients before sending SMS communications through our platform.
  • Not use the Service to send unsolicited, deceptive, or fraudulent messages.
  • Maintain all required insurance licenses and comply with industry regulations.
  • Immediately honor all opt-out requests from your clients.
  • Maintain accurate records of client consent for all communications.
  • Use only your own client data — data from clients with whom you have a direct relationship and from whom you have obtained proper consent.

5. User Responsibilities — Consumers

If you are a consumer receiving communications through our platform, you acknowledge that:

  • You have provided your phone number and consent to receive SMS messages to the insurance agent or agency contacting you.
  • You may opt out at any time by replying STOP to any message.
  • You are responsible for any message and data rates charged by your mobile carrier.
  • Providing consent to receive SMS messages is not a condition of purchasing insurance products or services.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and designs — are the exclusive property of Symreach and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written consent.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Symreach does not warrant that the Service will be uninterrupted, error-free, or secure. Message delivery is subject to carrier network availability and is not guaranteed.

8. Limitation of Liability

To the fullest extent permitted by law, Symreach and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory. Our total liability shall not exceed the amounts paid by you, if any, for the use of the Service during the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Symreach and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of a third party.

10. Termination

Symreach may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in the State of Florida.
